Though they’re called Cheap Trick, the band is filing an expensive lawsuit against the Ottawa Bluesfest after a stage collapse during their July 2011 performance.

The million-dollar suit comes two years after high winds ripped down their stage set-up at the Canadian festival, hospitalizing three people and destroying much of the band’s equipment. Band members were able to escape the structure before it collapsed.

According to Billboard, the band’s legal representatives claim event officials, along with the stage company, did not monitor weather conditions or alert the band of any potential danger. The severe conditions reportedly ripped down the outdoor stage’s wind walls, causing it to buckle and fall. Watch footage of the incident below.

Cheap Trick Touring, Inc. claimed in a July 4 statement that the festival put “economic considerations over safety,” and did not adhere to Ottawa Building Code. The claim also notes that event staff were not properly trained of emergency protocol.
