Macadamia Madness 2010 Promotion Rules – Revised (1/15/2010)

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED.

1. HOW TO ENTER

a. These rules govern the 2010 Macadamia Madness Promotion (the “Promotion”) being conducted by KRTH (the “Station”) beginning on Monday, January 11, 2010 at 9:00am Pacific Time (“PT”) and end on Friday, December 31, 2010 at 5:00pm PT. Special holiday or countdown programming may affect contesting.

b. To participate in the Promotion, you may enter via the following method:

There are two separate drawings and qualifying periods per week. For your chance to qualify for the first weekly drawing – Listen to KRTH-FM between the following hours during the promotion period: Mondays 9am to Midnight PT, Tuesdays 9am to Midnight PT and Wednesdays 9am – 5pm PT. One (1) winner will be drawn from these qualifiers each Wednesday in the 5pm hour PT.

For your chance to qualify for the second weekly drawing – Listen to KRTH-FM between the following hours during the promotion period: Wednesdays 6pm to Midnight PT, Thursdays 9am to Midnight PT and Fridays 9am – 5pm PT. One (1) winner will be drawn from these qualifiers each Friday in the 5pm hour PT.

At the top of each hour during the designated Promotion periods a KRTH DJ will designate what number caller to be when you hear the sound of the K-EARTH 101 JET “Fly By” played between songs some time in that hour. When the Jet “Fly By” sound plays, be the correct designated caller received to 1-800-232-KRTH. Upon confirmation of eligibility, you will be qualified for the current period’s drawing. At the time of their call, callers will be required to provide all information requested including their full name, complete address (including zip code), day and evening phone numbers and date of birth in order to be eligible to win. In the event that the selected caller is disconnected or is found to be ineligible, the next eligible caller that successfully makes it through on the call-in line and completes their call will be qualified.

There is no limit to the number of times a listener may attempt to call in to qualify, but a listener may only qualify once per drawing period. Qualifiers may only win the Macadamia Madness contest once per year. The Station is not responsible for telephone service outages, delays, busy signals, equipment malfunctions and any other technological difficulties that may prevent an individual from completing his/her telephone call. Due to delays in the KRTH online streaming of its broadcast signal, listeners to the online stream may not be able to participate in or may be disadvantaged in participating in on-air contests.

A total of thirty eight (38) qualifiers will be in the running for each Wednesday drawing and twenty nine (29) for each Friday drawing.

2. ELIGIBILITY RESTRICTIONS

a. The Promotion is open to all persons who are 18 years of age or older and who reside in the following Southern California Counties: Los Angeles, Orange, Riverside, San Bernardino, Ventura and San Diego. Employees of Station, its licensee, the licensee’s parent, subsidiary and affiliated entities, Station’s advertising and promotional agencies, its participating sponsors, other radio stations in the metropolitan area (see above for all eligible counties), the members of their immediate families (spouse, parent, sibling or child) and those living in the same household of each (whether related or not), are ineligible to enter or win. This Promotion is subject to all applicable federal, state and local laws and regulations and is void where prohibited.

b. Only one winner per household is permitted in any Promotion.

c. Grand Prize winner must possess valid government-issued photo identification and provide their complete address, date of birth and phone number to claim a prize.

d. Listeners can only qualify once per given week.

e. All Qualifiers names do not carry over from week to week. Listeners must try to re-qualify to be in the running for the trip to Hawaii for each new week.

f. Grand Prize winners can only win one (1) trip to Hawaii during the entire Promotion period.

g. Listeners may qualify and win the trip to Hawaii even if they won a Promotion on KRTH-FM less than thirty (30) days prior, however if they win a trip to Hawaii, they can not win another prize with KRTH-FM for a (1) year.

h. Entrants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will disqualify any entry from individuals who do not meet the eligibility requirements.

3. PRIZES

a. Up to a total of 102 Grand Prizes will be awarded during the Promotion. Each Grand Prize winner will receive a prize certificate valid for one (1) 5 day/4 night stay for two (2) in an standard room at the designated hotel in Hawaii (see 3b for hotel awarded during certain time periods), airfare for two (2) on from LAX. Winner will receive a certificate for hotel stay and information on booking airline flight.

b. CURRENT AIRFARE PROVIDED:

i. Winner will receive two (2) prize certificates which may be used for roundtrip air transportation for two (2) to an airport near the current resort destination, subject to availability, blackout dates, and other restrictions. Class of tickets will be based on the discounted contracted class fares through ticket consolidators of All Star Travel Group. Not valid on published fares unless the published fare is lower than the contracted fare.
ii. ALL STAR TRAVEL GROUP CONTACT INFORMATION WILL BE RECEIVED BY WINNER UPON SIGNING OF RELEASE & W9 FORMS
iii. Prize Winners and their travel companions are solely responsible for all applicable taxes, including, but not limited to, ground transportation, hotel, hospitality and airport taxes, telephone charges, meals, gratuities, transfers, spending money and any other expenses not specifically offered herein. The guests of the Grand Prize winners must also be at least 18 years of age or older or be accompanied by a parent or legal guardian. The guests of the Grand Prize winners must travel on the same trip itinerary as winners. Winners and guests are responsible for obtaining passports, visas, or any other requisite travel documentation prior to international travel.
iv. Hawaii: Kauai Flight Blackout dates:
3/12/20010 – 4/15/2010, 6/11/2010-8/31/2010, 11/15/2010 -11/30/2010 & 12/11/2010-1/9/2011.

Blackout dates can change at any time.

c. Certificates for hotel are non-transferable and cannot be sold or exchanged to a 3rd-party. Certificates cannot be exchanged for another prize. Accommodations and flight are on a space available basis and availability and are not valid during designated blackout dates. Certificates will be valid one year from certificate date. No extensions on certificate expiration date will be offered. If certificates are lost or stolen, no replacement will be given to the winner and prize will be forfeited. If winner wishes to upgrade, it will be based on availability and will be responsible to pay the difference in cost between the prize certificate and the upgrade cost. Approximate retail value of prize shown below under “c”. Change/Cash refund will not be given. Winner is solely responsible for booking their own hotel and airline with the winning certificate.

d. Winner is solely responsible for all fees associated with the prize which include but are not limited to all applicable hotel taxes, airline taxes, all meals, all beverages, spending money, hotel incidentals, ground transportation, hotel and airport transfers.

CURRENT Hotel Awarded:

January 11, 2010 – April 2, 2010 – Winners during this time period will stay at the Kauai Marriott Resort & Beach Club, Kalapaki Beach, 3610 Rice Street, Lihue – Kauai, Hawaii 96766.

CURRENT PRIZE ARV: $3,924

f. Hotel and airfare provider are at the sole decision of KRTH-FM and hotel and airline provider. Destinations subject to change. Destinations cannot be exchanged or traded for another resort awarded at another time. Hotel and Hawaii airport destination dates are subject to change.

g. All other costs not specifically stated herein, including but not limited to those of, taxes, meals, tips and ground transportation to/from the airport and to/from the hotel, are the responsibility of the winner. The winner and travel companion(s) must travel on the same itinerary and are responsible for obtaining all required travel documents, including, without limitation, passports for international travel. The winner may be required to present a valid credit card upon hotel check in to cover any incidental expenses incurred during the winner’s stay. The winner and travel companion(s) must sign a Publicity, Liability Waiver and Travel Release form prior to traveling. If a selected event is unable to take place as scheduled, for reasons such as cancellation, preemption, postponement or unavailability, or for any reason beyond the control of the Station, the Station’s sole responsibility to the winner will be to award the remaining available portion of the prize and no substitution or compensation will be provided for the unawarded portion of the prize. The Station reserves the right to remove or to deny entry to the winner and/or travel companion(s) if either engages in a disruptive manner or with intent to annoy, abuse, threaten or harass any other person.

h. All prizes or prize certificates may be picked up at the office of the Station at the address below. The winner will forfeit any prize or prize certificate not claimed within forty-five (45) days of winning. In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its loss. The Station is not responsible for the safe arrival of a prize or prize certificate.

i. There is no substitution, transfer or cash equivalent for prizes, except that the Station may, at its sole discretion, substitute prizes or cash of comparable value. The prizes are expressly limited to the item(s) listed above and unless otherwise expressly specified, do not include taxes, gratuities or any other expenses. Other restrictions may apply.

4. WINNER SELECTION AND NOTIFICATION

a. Decisions of KRTH-FM management with respect to the Promotion are final.

b. Up to a total of 102 Grand Prize winners will be selected during the Promotion. Each week, a total of thirty-eight (39) Qualifiers will be in the running for the first drawing period and twenty-nine (29) for the second.

c. Winners need not be present, but must listen to the Station to win.

d. Odds of Qualifying via call-in method depend on the number and order of calls received. Odds of winning the first Grand Prize are 1 in 38 and for the second 1 in 29.

e. Grand Prize winners will be notified by phone- immediately following each weeks drawing on Wednesday and Friday between 4:40pm PT and 5:40pm PT (once the last qualifier for each weekly contest period has been selected). The winners will be announced on air at 5:40pm PT. Promotions will contact winners about prize distribution. Each Grand Prize winner must execute and return any required affidavit of eligibility and/or liability/publicity release within thirty (30) days of winning or prize will be forfeited and an alternate winner may be selected by a random drawing from that’s week’s qualifiers. If a potential winner cannot be contacted, fails to sign and return the required affidavit of eligibility and/or liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, the potential winner forfeits the prize

5. CONDITIONS

a. Payments of all federal, state and local taxes are solely the responsibility of the winner. The winner will be required to complete and submit an IRS Form W-9 with the winner’s full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by the Station (or any other station owned by the corporate entity that owns the Station) in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in forfeiture of the prize. Such winnings of $600 or more will be reported to the IRS.

b. By participating in the Promotion, the winner agrees to have the winner’s name, voice and likeness used in any advertising or broadcasting material relating to the Promotion without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.

c. Prior to awarding any prize or prize certificate, the Station, in its sole discretion, may require Promotion winner (and any travel companion(s) or guest(s)) to sign a liability release, agreeing to release and hold harmless the Station, its licensee, the licensee’s parent, subsidiary and affiliated entities, their respective officers, shareholders, directors, employees, agents and representatives and all of their successors and assigns from and against any and all claims or liability arising directly or indirectly from the prize and participation in the Promotion.

d. If for any reason this Promotion cannot be executed as planned, including, but not limited to, as a result of infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Station that corrupt or affect the security, administration, fairness, integrity or proper conduct of the Promotion, or if the Promotion is compromised or becomes technically corrupted in any way, electronically or otherwise, the Station reserves the right to cancel, terminate or modify the Promotion. If the Promotion is terminated before the original end date, the Station will select the winners by random drawing from among all eligible non-suspect entries received as of the termination time/date.

e. The Station, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of the Station’s website. Failure to comply with the rules of the Promotion may result in a contestant’s disqualification and/or forfeiture of any prize or prizes. If the Station makes a good faith determination that an entrant has cheated or committed fraudulent activity in connection with a Promotion, the Station reserves the right to disqualify that entrant from entering and/or winning future Promotions and to prosecute and seek damages to the fullest extent permitted by law.

f. The Station reserves the right to make changes in the rules of the Promotion, including, without limitation, the substitution of a prize of equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Station, any competition or prize-related event or travel is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to cancel or modify the Promotion and shall not be required to award a substitute prize.

g. The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the Promotion or in the announcement of a prize.

h. For a copy of these Official Rules, send a self-addressed stamped envelope for receipt by Friday, December 31, 2010 to “Macadamia Madness– Official Rules,” Attn: Promotions, KRTH, 5670 Wilshire Blvd. Suite 200 Los Angeles, CA 90036. For the names of the prize winners send a self-addressed stamped envelope for receipt by February 27th, 2011 to the above address marked “Macadamia Madness– Winner List.” The Official Rules and the Winner List (when completed) shall also be available during regular business hours at the main offices of the Station and shall be posted online at www.kearth101.com.
